The subclass 804 Aged Parent visa, is a permanent visa that allows ‘aged parents’ of an Australian citizen, permanent resident, or eligible New Zealand citizen who is settled in Australia to live in Australia permanently.
The principal applicant must be of Australian pension age or older to be designated as an ‘aged parent.’
Given that the processing time for subclass 804 Aged Parent visas is currently 30 years or more, the subclass 804 Aged Parent visa is only a viable option if potential applicants can apply for the visa from within Australia and obtain a bridging visa to remain in Australia while the subclass 804 Aged Parent visa application is being processed.
In this case, unless they are insured by the Government, they must additionally obtain private health insurance while holding their bridging visa. In this situation, UK passport holders are protected under Medicare. Other possible applicants should try applying for a Contributory Aged Parent visa under subclass 864.
How Can you Qualify for a TSS Visa?
If you have the ability to fill a job opening with an Australian company, you may be eligible for the TSS visa. The TSS visa is available in three (3) streams:
Occupation
The job that the business seeks to fill must be on the Combined List of Eligible Skilled Occupations. The Department of Home Affairs (previously DIBP) uses the Australian New Zealand Standard Classification of Occupations to determine if the proposed nominated profession accurately reflects the requirements of the position (ANZSCO).
Applicant Skills
The applicant must possess the necessary expertise to perform the job. While the expertise necessary differs depending on the occupation, all TSS visa applicants must have at least two years of relevant work experience. Home Affairs case officers cross-reference the position description submitted in the employer’s nomination application with the visa applicant’s qualifications and work references when examining a TSS visa applicant’s skills and qualifications against the nominated post.
If applicants are not from an accepted nation (the United Kingdom, the United States, Canada, New Zealand, or Ireland), they must also meet English language criteria at the time of application.
Other Information
Health and character requirements must also be met. Police clearance certificates are necessary for any country where the candidate has lived for 12 months or more since turning 16 in the last ten years.
How Can You Apply for a TSS Visa?
There are three steps to the TSS 482 Visa Migration process.
1 – Standard business sponsorship
To hire a TSS visa holder, a company must first be approved as a Standard Business Sponsor. To secure a Standard Business Sponsorship agreement, the company must be legally and actively operating in Australia.
There are a few things you need to take care of when you’re starting up a company in Australia. You need to make sure you have the correct ABN, register your business name, submit your Business Activity Statements and financial statements, and show that you’re committed to training Australian citizens and permanent residents. You also need to make sure you’re complying with all the workplace and other laws in Australia.
2 – Nomination
Following the submission of the SBS application, an employer must specify a position inside their company as one that must be filled by an overseas citizen. Several needs must be met as part of this step:
- Labour Market Testing
To suggest a person for a TSS visa, a company must show that it has evaluated the labor market. Labor market testing comprises proving that the company unsuccessfully advertised for the specified post. The application will require evidence, and the evidentiary requirements are fairly detailed.
In most cases, three advertisements published during the last four months for a minimum of 28 days will suffice; nevertheless, there are times when this will not suffice, and more documentation is necessary. Also, there are certain exceptions to this condition. Employers are recommended to obtain professional guidance to ensure that the provisions for labor market testing are followed.
- Salary Level
The nominated position’s salary must match two criteria. To begin, the compensation must be greater than the Temporary Skilled Migration Income Threshold (TSMIT). DIBP determines this level each year, which is present at $53,900 plus superannuation. Second, the suggested wage must be competitive for the role. This assures that the applicant’s salary will be equivalent to that of Australian employees in comparable roles.
- Training Levy
With the introduction of the TSS visa comes a new Skilling Australians Fund (SAF) charge, which must be paid at the nomination stage. The SAF charge will significantly increase the cost of nominating personnel for a business.
3 – Visa Application
The third and final stage of the process is the visa application, in which the nominee must show that they meet the required skill level for their occupation through paperwork as well as health and character requirements through an interview. Similarly, These variables define the visa program’s requirements and restrictions. At the same time, applicants must first and mainly pass their IELTS training.
